Copies of the town’s tax maps are included to assist you in locating Class VI roads, trails and boating and fishing access sites. Each tax map has a large map number located on the lower right corner of the page. Italicized numbers along the edges of the tax maps refer to adjacent tax maps. The small numbers within circles are the lot numbers. “P/O” indicates that the lot is “part of” the designated map and lot.
Class VI Roads are defined by New Hampshire Statute 229:5 VII as “…all other existing public ways, and…include all highways discontinued as open highways and made subject to gates and bars…and all highways which have not been maintained and repaired by the town in suitable condition for travel thereon for 5 successive years or more.”
“The term “gates and bars” was not and is not, statutorily defined.” And “…anecdotal evidence suggests, namely that “subject to gates and bars” historically referred, and still does refer, to an owner’s right to enclose premises for his/her own benefit—primarily to restrain livestock. The owner has the right to require passersby to open and reclose the gate or bars, as a condition of exercising the public right to travel on the highway.”[1]
